Terms & Conditions
1. Scope & Contracting Parties
(1) These General Terms and Conditions (GTC) apply to all contracts for the rental of apartments for accommodation and to all related services between ALPSTAY Apartments and the guest.
(2) The contracting party is: ALPSTAY Apartments – Daniela Danzinger (hereinafter referred to as “Landlord”)
(3) Any differing terms and conditions of the guest shall not apply unless expressly agreed to in writing.
2. Contract Conclusion & Booking
(1) By making a booking, the guest makes a binding offer to conclude an accommodation contract.
(2) The contract only comes into effect upon confirmation of the booking by the landlord.
(3) Offers on the website or other platforms are non-binding and do not constitute a legally binding offer.
(4) The landlord reserves the right to refuse bookings without giving reasons.
(5) There is no entitlement to a specific apartment. The landlord is entitled to provide equivalent accommodation.
3. Prizes
(1) The prices displayed at the time of booking shall apply.
(2) All prices are total prices including statutory taxes and duties, unless otherwise stated.
(3) Local charges (e.g. tourist tax) may be shown and charged separately.
4. Payment terms
(1) The total price is payable in advance unless otherwise agreed.
(2) The landlord is entitled to demand a deposit (e.g. 20%).
(3) Acceptable payment methods are credit card, debit card or bank transfer.
(4) The landlord is entitled to settle outstanding amounts via the deposited payment method in the event of damages, additional services or violations of these terms and conditions.
5. Cancellation Policy
Cancellation policies may vary depending on the accommodation and will be displayed during the booking process.
5.1 ALPSTAY Apartments
- Free cancellation up to 30 days before arrival
- 29 to 14 days before arrival: 50% of the total price
- Less than 14 days before arrival or no-show: 100% of the total price, unless the property is re-let.
5.2 Chalet Bergblick
- Free cancellation up to 14 days before arrival
- Less than 14 days before arrival or no-show: 100% of the total price, unless the property is re-let.
(1) Cancellations must be made in writing (by e-mail).
(2) The guest is free to prove that no damage or less damage has occurred.
6. Arrival and Departure
(1) Check-in: from 4:00 PM (2) Check-out: until 10:00 AM
(2) Early check-in and late check-out are only possible by prior arrangement and subject to availability. A surcharge of €10 per hour may be charged for this.
(3) There is no entitlement to this.
7. Use of the accommodation
(1) The accommodation may only be used for lodging purposes.
(2) Transfer, subletting or commercial use is not permitted.
(3) Taking photographs or videos for commercial purposes is only permitted with express consent.
8. Transfer / Resale
(1) The transfer or resale of bookings is prohibited.
(2) In case of violation, the landlord is entitled to cancel the booking without refund.
9. Keys & Access
(1) Access is via digital systems or keys.
(2) In the event of loss of a key, a flat fee of €80 will be charged.
(3) Additional costs (e.g. replacement of the locking system) may be charged separately.
10. Guest's Obligations
(1) The guest undertakes to treat the accommodation with care.
(2) Any damage incurred must be reported immediately.
(3) The guest shall be liable for damages caused up to the amount of the replacement costs.
11. Cancellation by the landlord
The landlord is entitled to withdraw from the contract if:
- Force majeure applies
- the accommodation cannot be provided
- the guest violates essential terms of the contract
In this case, any payment already made will be refunded.
12. Liability
(1) The landlord shall only be liable for damages caused by intent or gross negligence.
(2) No liability is assumed for items brought onto the premises unless there is a legal obligation to do so.
13. House Rules
The house rules are part of these terms and conditions and must be observed by the guest.
14. Final Provisions
(1) Austrian law applies.
(2) The place of jurisdiction is – to the extent permitted – the landlord's place of business.
(3) Should individual provisions be invalid, the validity of the remaining provisions shall remain unaffected.
